Terms & Conditions
These terms set out the basis on which Pelita provides home support arrangements for older relatives in Kuala Lumpur. Please read them carefully before making use of our services. By enquiring, booking, or otherwise engaging with Pelita, you are agreeing to these terms.
1. Definitions
The following terms carry the meanings set out below throughout this document:
- "Agreement" means these Terms & Conditions together with any written service arrangement or written communication agreed between you and Pelita.
- "Service" means the home support arrangements offered by Pelita, including Festive & Occasion Support, Errand & Appointment Logistics, and the Social Engagement Programme.
- "We", "Us", "Our" refers to Pelita, operating from No. 52, Lorong Rahim Kajai, 60000 Kuala Lumpur, Wilayah Persekutuan, Malaysia.
- "You", "User", "Client" refers to the individual or family engaging with Pelita — whether as a direct user of the website or as a person arranging services for a relative.
- "Relative" or "Older Relative" means the elderly household member for whom the services are arranged.
- "Content" refers to any materials, written communications, schedules, activity summaries, or documentation produced by Pelita in connection with the Service.
- "Site" means this website, accessible at pelitan.blog.
2. Acceptance of Terms
By contacting Pelita, submitting an enquiry form, or entering into a service arrangement, you confirm that:
- You are at least 18 years of age.
- You have the legal capacity to enter into a binding agreement.
- If you are arranging services on behalf of another person, you have their knowledge and, where relevant, appropriate authority to do so.
- You have read and understood these terms and agree to be bound by them.
If you do not agree with any part of these terms, please do not proceed with engaging our services.
3. Service Description
Pelita provides coordination, companionship, and household assistance arrangements for older relatives in the Kuala Lumpur area. Our services are non-medical and do not constitute any form of regulated professional activity.
Services currently offered:
- Festive & Occasion Support — occasion planning, helper coordination, and on-the-day support for birthdays, family visits, and similar occasions.
- Errand & Appointment Logistics — coordination of grocery runs, parcel collection, transport arrangements, shared calendar management, and confirmation messages.
- Social Engagement Programme — monthly activity scheduling, companion accompaniment to outings, and a monthly family summary.
Services are subject to availability and geographic limitations within the Kuala Lumpur area. Pelita reserves the right to decline service requests that fall outside our scope or operational capacity.
4. User Responsibilities
As a client, you agree to:
- Provide accurate and complete information when making enquiries or arranging services.
- Communicate any relevant changes — such as changes to the older relative's routines, home circumstances, or preferences — in a timely manner.
- Ensure that the older relative or household is informed about and, where applicable, comfortable with the support being arranged.
- Make payments on agreed terms.
- Treat Pelita staff and companions with respect and courtesy.
- Not request services that fall outside Pelita's stated scope, including any activities of a regulated professional nature.
You agree not to use the Site or Services for any unlawful purpose, to transmit harmful or offensive communications, or to misrepresent your identity or relationship to the older relative.
5. Intellectual Property
All content on the Pelita website — including text, layout, logos, and documentation — is owned by or licensed to Pelita. You are granted a limited, non-exclusive, non-transferable licence to access and view this material for personal, non-commercial purposes.
You may not reproduce, distribute, modify, or commercially exploit any content from the Site without prior written consent from Pelita.
Service reports, activity summaries, and occasion plans produced by Pelita for a client's use remain the property of Pelita but are shared for your personal use in connection with the arranged services.
6. Payment Terms
Service fees are quoted in Malaysian Ringgit (RM) and include:
- Festive & Occasion Support: RM 620 per occasion.
- Errand & Appointment Logistics: RM 2,300 per month.
- Social Engagement Programme: RM 3,600 per month.
Payment terms are confirmed in writing at the time of arrangement. Pelita accepts payment via agreed methods communicated during onboarding. All fees are non-refundable once a service period has commenced, except where Pelita is unable to deliver the agreed service.
If a recurring arrangement is cancelled mid-month, no partial refund is issued unless otherwise agreed in writing. We encourage families to discuss any concerns before the arrangement period begins.
7. Service-Specific Terms
Festive & Occasion Support
Occasion plans are prepared in consultation with the client ahead of the event. Scope is agreed before the occasion date. Requests for significant changes close to the occasion date may not be possible to accommodate.
Errand & Appointment Logistics
Errand schedules are coordinated with the client and shared via a mutually agreed channel. Confirmation messages are sent after each errand is completed. Cancellations or changes to scheduled errands should be communicated at least 24 hours in advance where possible.
Social Engagement Programme
Monthly activity calendars are prepared at the start of each month. Changes to the older relative's preferences or circumstances should be communicated as soon as practicable. Monthly family summaries are shared within seven days of the end of each calendar month.
8. Disclaimers
Pelita's services are provided as a companionship, coordination, and household assistance arrangement. We do not provide any form of regulated professional advice or activity, including but not limited to medical, legal, or financial advice.
Our services do not substitute for professional care when such care is needed. Families are encouraged to maintain appropriate support structures for their older relative alongside any arrangement with Pelita.
The Site and its content are provided on an "as available" basis. Pelita makes no representations as to the completeness or ongoing accuracy of information on the Site.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Pelita's total liability to you in connection with any service arrangement will not exceed the amount paid by you for that specific arrangement.
Pelita will not be liable for any indirect, consequential, or incidental loss arising from the use of our services or any failure to deliver services due to circumstances outside our reasonable control, including events of force majeure such as severe weather, public emergencies, or infrastructure disruptions.
10. Indemnification
You agree to indemnify and hold harmless Pelita, its staff, and associates from any claims, losses, or expenses arising from your breach of these terms, your misuse of our services, or any inaccurate information you provided that led to a service being arranged inappropriately.
11. Termination
Either party may end a service arrangement by providing reasonable written notice. We consider two weeks' notice reasonable for recurring monthly arrangements, unless otherwise agreed.
Pelita may discontinue a service arrangement immediately where a client or household member behaves in a manner that places our staff at risk, or where the arrangement has become untenable for operational reasons.
On termination, any fees for services already delivered become payable. These terms continue to apply to any outstanding matters after termination.
12. Dispute Resolution
These terms are governed by the laws of Malaysia. We encourage any client with a concern to contact us directly at [email protected] so we can discuss the matter informally and reach a resolution without the need for formal proceedings.
If an informal resolution is not possible, disputes shall be subject to the jurisdiction of the courts of Kuala Lumpur, Malaysia, in accordance with applicable Malaysian law.
13. General Provisions
- Entire Agreement: These terms, together with any written service arrangement confirmed by Pelita, constitute the full agreement between you and Pelita in relation to the services.
- Severability: If any clause is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Any failure by Pelita to enforce a provision does not constitute a waiver of that provision.
- Assignment: You may not transfer your rights or obligations under these terms without Pelita's written consent.
- Notices: Formal communications should be sent to [email protected] or by post to our registered address in Kuala Lumpur.
14. Changes to These Terms
We may revise these terms from time to time. When we do, the updated version will be posted on this page with a revised "Last Updated" date. Where changes are material, we will aim to inform existing clients by email.
Continuing to use our services after changes are posted constitutes your acceptance of the revised terms.
